I would say don't lend it to mates who are going to thrash it!

There is one person who drives my car and that's me. The only other person I have let drive it is my dad and I trust him. I would only let my mates drive it if I was in the car with them. Big Smile

Advice to anyone dont lend the car out to anyone at any time cos  it took me a hell of a long time to find the person who was driving at that time  i new for sure that i wasnt speeding cos im always looking at my speedo to make sure, i kept ringing and chasing people up until i did.

remember if that person who driven my car did not own up id wud have to accepted the points and thus be banned and ma beamer wud have had to been sold as i wud not have been able to afford the insurance.

Yup I found that on the day of the offence that i was not the driver and the culprit who had the keys to  my  car has finally owned up and has accepted his faults.

PS:- I wouldn't use the old uncle sam trick too risky and perverting the course of justice is big poo as well.

so me happy and i wont be lending the car out to anyone again.

Yeh but after the car was registered on 31st of july they had 1 month to get in contact with the registered keeper  who was me and like i said the letter did not get to me until 2nd sept 2005.

My uncle has accepted the points and all is clear.

Hi

Sorry I didn't see your final post where you say it's been sorted but I've written the reply so I'll post it anyway.

First off you've got to put your uncle in the frame for the time he was speeding in your car; I'm glad he's not my uncle!

Second your dealer from whom you bought the car gave you completely duff info. It's an offence not to notify DVLA when you sell a car. This happened to my mate who kept getting letters through the post about unpaid parking tickets; and the old bill calling on him about his old car leaving petrol stations without paying for petrol. He'd sold the car 8 months previously and hadn't sent his log book off.

The dealer should have sent the log book to DVLA as soon as he sold it to you. There is a section on the logbook for dealers. I think this is so that the number of previous keepers isn't increased when a dealer gets it and sticks it on a forecourt.

An N.I.P. (Notice of intended prosecution) has to be served on the registered keeper for a speeding offence within 14 days. The N.I.P. was probably served on the dealer who sold you the car or the person who he had it from. That's it; it's just a legal requirement. You got the letter late probably because the N.I.P was served on the registered keeper who bounced it back and eventually the trail lead to you.

Fight it at court and you loose; the fine is always higher. They've got the speeding offence procedures pretty sewn up because every excuse in the book has been tried. As the owner of the car you can be compelled to declare who was the driver at the time of the offence. I've heard of students selling their licences and accepting the points for you. Another mates wife took points for him because he was on 9 points and facing a ban. Get caught doing this though and you're looking at perverting the course of justice....BIG POO!

Get your uncle to do the honourable thing and accept his points.

There's a good chance the cases will be dropped, but you still have to reply to the letters.  I just don't know how you go about it.

Looks like you've got 2 choices. 

1. Take the 3 points and put your uncle down as the driver on the other ticket (if he was definitely driving)

2. Talk to a solicitor and you may get off both tickets, but it will cost you a bit of money just to find out. 

The longer you sit on them, the more likely you'll have to go to court over them and may be even worse off.

The dealer sold me the car so he is respnsible for that dvla told me that i do not need to register it as it was not important so i left it until i taxed the vehicle but after taxing on the 31st of july they had 1 month to send me the ticket.

Just one thing you have forgotten.

How can they let you know about the speeding offence WHEN YOU DID NOT TELL THEM UNTIL END OF JULY that you are the actual owner of the car. How can this be if the previous owner is suppoosed to send off part 1 of the registration form.

If I was some 'toe rag' at the DVLA I would be thinking about fineing for that also.

My dad was just let off this by a stroke of luck

The law states that - the owner registered with the dvla at the time
of the offence must be notified within 14 days given allowances for
postage.

Dad was in the same situation as you, but the old owner accidently
gave the wrong address and it took 6 months to track dad down.

He sent back a lovely letter saying there was no way he could
remember who was driving at the time of the offence 6 months ago
and they subsequently dropped the charge.

If you can point me to the Act or case law which says it is 14 days, I'll look into it.  Maybe you can  get off on a procedural ground.

I gotta worry if i lose my licence my insurance jumps on ma beamer to £1200 and thats 3rd party when im at the mo paying £597 fully comp so i got it made at the moment and i may have blew it through ignorance although some of the roads you come across display a picture of a camera but no speed limit sign so how you supposed to know if its a 40 or 30 ? they pull you over for going too fast and they pull you over for going too slow you cant win.

The rules are stupid with speed cameras and in my opinion im pretty sure it can cause more accidents half the time im too busy looking at the speedometer than the road jus to make sure im at the right speed ?.

surely that cant be good there has got to be a leaway and they got to be less strict theres too many cameras on almost every road and innocent people have been caught as well more and more people are driving illegally without licences and bans.
