This was a hot topic in a local hostelry recently...
The people that I was talking to knew the farmer and the section of road involved very well.

Their version is that there were plenty of places to pull in if he had no trailer attached... However, he had.

He pulled in at the first place that he could comfortably get the tractor & trailer in off the road. Apparently an experiment was carried out on the "6 places" and in every case the trailer would be jutting out on the road causing following traffic to cross the white line...

The question put to me, and now I'll put to you is;
What would you do?

It's being appealed I'm told and expects a full dismissal of the charge...

PS: The maximum speed of the particular tractor is 15-17mph with the load behind. Rules of the road allow him to drive at that speed... The judge was clearly wrong but the way the defence was run may not have helped... (And I won't mention what the particular member of the judiciary drives...)

Apparently if you are driving e.g. on the N17, single carriageway, and pull in on the "hard shoulder" to let traffic pass - you are breaking the law also... We all do it but if a particular guard wishes he could prosecute you for that also.. The guards hold the aces and at District Court level the law is not applied equally or similarly in different courts.. An appeal to the Circuit is usually successful in these cases but very expensive..

Yes everyone has the right to use them - according to the Rules (& Laws) of the Road.

IMHO many cyclists (and I don't include myself) have a total disregard for the laws - and what do the police do?

Nothing!!!!!

AFAIK it was his manner in court and his refusal to pay an initial fine (given on the roadside) which earned him his year.

Since when did 15mph become the standard for transporting cattle? The fact he didn't pull over is probably what got him done though.

Cyclists near me regularly break numerous laws.  Passing red lights, riding two or more abreast, cycling on pavements, cycling the wrong way on one way streets, failing to give way.  I have no time for cyclists.

If they are on our roads, they should be chuffin' well paying road tax.

Be exclusive and drive a Petrol 5 Series!
