Can I safely change to a staggered setup on my E39 530d with 8.5J rears instead of 8J all round?  TIA

Have a look at http://www.realoem.com/bmw/ it would appear that you can get up to 9" wide rims on an E39.

I've heard that Touring models need narrower wheels at the rear to clear suspension components compared to the saloon models.

If it is an auto beware about changing the wheel widths between front and rear axles as you will then get a corresponding change in rolling radii, this in turn upsets the autobox as you are then getting differing speed signals being sent to the ecu which controls the shift points of the transmission.  I've got wider rims on the rear but as the combination of width and tyres was a BMW factory fitted option there is no change in rolling radii on my car.  If you stick to a BMW option list combination of wheel widths and tyre aspect ratios you will be fine.  Stray from this and you may be in bother.

If it's a manual then you are not affected by changing the radii of wheels.  Batter on.

As Andrew says stick to proper BMW alloys and you'll have no problems. A set of 17" or 18" e39 Sport alloys will go on no probs.
