just bought a set of 18's for my bmw , guy had them for sale for a mate for a while ,lightly scuffed and needed one new tyre , private sale but he took paypal from me , so shot upto glasgow for them the night , came home thought **** it jacked the car up at 22.30 and guess what they dont fit :( :( :( he assured me they fitted a bmw as his mate had them on his bmw ... so measured the pcd an dits ******* 5x110 , no where near ****** 5x120 ... they are for a saab or a 5 stud vectra ..

Phoned him and emailed him but no reply was think of going down the refund option from paypal but ot sure how it works for a private sale as usually its through ebay ...

am sooooooo gutted ... the wheels would have looked trick too ...

Stick on a claim to paypal as unfortunately they always seem to get your money back (Not great when you are a seller)

You will no doubt have to send goods back first, but i have have had many refunds (Honest ones i might add)

i thought that but wantted to speak to the guy first , because i need to take them back up and he could just say he ever got them back , so then id have no money and no wheels ...

would have rather been on good terms with the guy gone up and got him to refund my money while i was standing there ... and then check my paypal account so i know its went in , either that or go up and get cash for the return of the wheels , either way am gutted and not letting it go, cos you dont advertise wheels for a totally different car ..

!!!!!!! still gutted thought i d be on 18's tomorrow ..

do paypal have any say in the sale itself i always thought they just processed the transaction.

don't think you will be able to got through ebay tho if it was a private sale.

just go up with the BMWCC possy and demand a refund

all i meant was that my normal transactions are through ebay - paypal ,

never knew the ins and outs of a private sale and the difference of their protection policy covers the seller /buyer or not ..

Try "Sale of Goods Act" - fitness for purpose

Originally posted by http://www.bbc.co.uk/consumer/guides_to/law_goods.shtml - BBC Website http://www.bbc.co.uk/consumer/guides_to/law_goods.shtml - BBC Website wrote:

the only phrase you need to memorise is 'The Sale of Goods Act 1979 (as amended)'.

The 'as amended' is important because it refers to laws which have extended the basic 1979 Act and using the phrase tells the trader that not only do you know basic consumer law, you know it has been amended too.

The Sale of Goods Act lays down several conditions that all goods sold by a trader must meet.

The goods must be:

 • as described
 • of satisfactory quality
 • fit for purpose

heres what paypal say :

PayPal encourages all buyers to communicate with their sellers to resolve issues with transactions. If you are unable to resolve a problem outside of PayPal, you can open a dispute in the Resolution Centre and try to work out a resolution with the seller. If you are unable to fully resolve the dispute within 20 days, either you or the seller can escalate the dispute to a claim with PayPal. After 20 days, your dispute will be closed automatically. Learn how to file a dispute in the Resolution Centre with our https://www.paypal.com/uk/cgi-bin/webscr?cmd=xpt/customerservice/EducationBuyerOverview - step-by-step guide .

If the dispute is escalated to a claim, PayPal will decide if your claim is valid and provide options for resolving the claim. PayPal will determine which coverage applies to your claim during the investigation process and inform you of that decision.

If you purchased your item on eBay and your seller has insufficient funds to offer a refund, eBay's Standard Purchase Protection Programme will apply.

Because claims processed under this programme are subject to a 25.00 USD processing fee, you are not eligible for reimbursement if your eBay transaction is less than this amount.

Reqading the link I gave you earlier,

Quote The act covers second-hand items and sales. But if you buy privately, your only entitlement to your money back is if the goods aren't 'as described'.

Id turn up at his door with the wheels and get a refund for petrol on top of that, I grew up in greenock/port glasgow and found that the people there can be quite persuasive.

Its people like that that are giving ebay and buying things on the internet a bad name, if he were to sell you something that he lied about the description in say the evening times, then you would have no problem. Paypal and ebay currently have at any one time hundreds of people chasing money, and for bigger things than wheels.

allan the guy had them for sale on strathy , and they had been for sale for ages,

he was selling them for a a m8 . and i just paid for them with paypal , turned up as he was comming home from work , handed me the wheels and i put them in the car and headed off home , ( had the kids with me so want to get them home to bed as it was the back of 8 ).. it wasn't till i went to fit them i though hold on a min ...

and i measured the pcd ...and it was 110 and not 120 ,

its not something i would imagine anybody would lie about so never thought to check it when collecting them ... if you advertise a set of alloys to fit a certain car you'd normally expect themto fit that car ...

Shame him on strathy. He will be more likely to reply to you then, cos noone will buy anything else from him. Your right about the advertising thing tho. I did the same with an exhaust (long story but i think it probably would have fitted) but it didnt fit either. That was from a mate as well

Yes i agree with Noisufnoc, appear at his door with some mates and "persuade" him to give you a refund!! People like that just ruin it for genuine sellers!!!

no offence, but........ i'd have been back on his door step within "nano-second's" of finding they didn't fit, i'd have gave him his place to addmit fault and take my cash back, or if he didn't wanna play ball .....

PARTY ON!!

They would have looked nice on there Chris, one rule I learned very quickly is never leave any money where the wife can see it - you know instantly it will be earmarked for some thing to benefit her NOT you. Good luck on your next find for wheels. I've been trawling through eBay for e34's and found one or two lovely 530 V8's which may leave me in the doghouse yet again!
