My 2003 BMW 318i has paint bubbles around the front wheel arches The dealers have advised me to replace both wings BMW refuse to pay, quoting "out of date warranty". I have had this car from new  I'm flabbergasted. Have I any legal rights I can persue to force BMW to accept responsibility? Any helpfull advise please.

I don't know what the anti corrosion warranty on BMWs is but if BMW say you are out of it then I guess you are. To be honest you haven't got much legal footing but you could ask BMW if they would be willing to pay a contribution as a goodwill gesture.

I'm sorry to say BMWs rust proofing isn't as good as you might imagine.

BMW corrosion warranty is 6 years (was extended to 12 years from 2004).

If the rust is as a result of any unrepaired or delayed repair of damage or scrapes then they'll be within their rights to wash their hands of any responsibility.

Did you query any rust related issues with the dealer within the 6 year period, whether repaired or not?

A letter to Customer Service at BMW UK outlining the situation would be a starting point.

 In answer to Dergsides reply regarding reporting of any blemish/rust issues

  No I did not  have any cause to report any issues untill the last 6 weeks .I purchased the car in Jan 2003 I have been extremely carefull with the vehice it is virtually unmarked save for this paint bubbling appearing over the wheel arch.. I guess I dont have a legal leg to stand on .
 Peter has made a good point which I'm going to persue the "goodwill card" Then  a letter to Customer Service at BMW .

Your disappointment is understandable.  Its not something you'd expect to have to deal with in a 6 year old car.  30 years ago it wouldn't have been too unusual but not these days.

Goodwill and BMW Cust Service have produced a positive outcome of quite a few occassions.  There are two significant ones I'm aware of in my own family on cars that were outside warranty.

Did the dealer give any guidance, other than being out of warranty, to explain the decision not to help further?  Very often the dealer will suggest making a case for goodwill if the car is marginally out of warranty.
